Judgment for Beneficiary in a Trust Dispute

(Mesa – September 2010) In this case, a Decedent executed a Revocable Living Trust in 1999. The Trust dictated that upon death, his estate was to be split equally amongst his three children; with our Client’s share being held until she turns 65 years old. Well, upon attaining the age of 65 years, Client was surprised to discover that her share of the Trust was misused in a manner benefiting the Trustee. The Trustee denied all wrongdoing and alleged that she properly managed the trust estate. Nevertheless, after a lengthy trial before the Maricopa County Superior Court for the State of Arizona, it was found that Trustee indeed misused the trust assets and awarded judgment in favor of the client for Gorman Law Group.
