PROTECTING A TRUSTEE FROM SCRUPULOUS BENEFICIARIES

January 2015 – The litigation team at Gorman Law Group, PLC defended the administration of a Trustee of a Trust from breach of duty accusations made by certain beneficiaries. This trust had eight beneficiaries. Four of the eight beneficiaries accused the Trustee of misappropriation of trust assets, lack of an accounting and breach of duties. Sadly all eight beneficiaries and the Trustee were siblings and the issues amongst them were deeply rooted, extending way beyond the trust administration. Unfortunately, these deep rooted issues enabled the scrupulous beneficiaries to delay the settlement of the trust via their litigation tactics. In the end, the Trustee was exonerated and all legal fees and costs were awarded to be deducted from the beneficiaries share and awarded to the Trustee.
